Standard contractor agreements

A. When Monash engages an external consultant -

B. When Monash staff provide consultancy services -

These agreements have already been approved by the University Solicitor's Office. Therefore, a standard agreement should only be referred back to the Solicitor's Office if a change is required - other than a change to the insurance clause (insurance is not a matter for the Solicitor's Office and is covered in the Guidelines.)

Note: when the University is purchasing consultancy services, work should never commence before an agreement is signed otherwise the consultant might end up owning the project intellectual property. The standard consultancy agreement contains an assignment of intellectual property to the University. Payment alone does not make the University owner of intellectual property arising from services delivered by a consultant.
