| 1.1 |
Contracts, agreements and other documents may only be signed on behalf of the University if the person signing has an appropriate power to sign. Aside from the Vice-Chancellor, who has the power to sign by virtue of the Monash University Act 2009, the power to sign on behalf of the University is given by an instrument of delegation or sub-delegation. |
| 1.2 |
The Vice-Chancellor has general power to sign contracts, agreements and other documents on behalf of the University. |
| 1.3 |
The Vice-Chancellor has given a delegation of powers to sign contracts, agreements and other documents to the Deputy Vice-Chancellors, the Vice-Presidents and the Deans, with respect to matters for which they have responsibility. |
| 1.4 |
The delegates referred to in paragraph 1.3 have given a sub-delegation of powers to sign contracts, agreements and other documents to various persons who report to the delegates. |
| 1.5 |
These sub-delegations are either: (a) general (i.e. giving the sub-delegate general power to sign contracts etc. within the delegate's or sub-delegate's responsibility); or (b) specific (i.e. giving the sub-delegate power to sign specific documents or in specific circumstances). An example of a specific power to sign is the power to sign only agreements for the acquisition of services e.g. a standard Contractor Agreement. |
| 1.6 |
Where a delegate or sub-delegate has authority to sign a contract the person signing should also have the appropriate financial delegation to enter into the transaction. Refer to Financial Delegations matrix at http://intranet.monash.edu.au/finance/cfd/financial-delegation/value-limits.html |

A list of delegations, sub-delegations and authorities to sign can be found here.

| 1.8 |
Where agreements have been approved by the University as University "pro formas" (e.g. the standard contractor agreement refer to http://intranet.monash.edu.au/finance/purchase-to-payment/contractors/document-types/index.html) there is no need for them to be legally reviewed before signing. In all other cases, the agreement must be reviewed and approved by a lawyer for the University. |
| 1.9 |
Some agreements must be formalised under the official seal of the University and counter-signed by the Vice-Chancellor and a Deputy Vice-Chancellor or Vice-President. |
| 1.10 |
Deeds are agreements with special signing requirements - refer to Statute 8.1 and the regulations made under Statute 8.1 in particular regulation 4. |
